Terms and Conditions for Online Auctions

1. All online auction sales will be conducted according to the following plus any other conditions added via email or posted on 2riversauctions.com. In bidding you consent to be bound by these terms and conditions.

2. All registration information a Bidder provides to 2 Rivers Auctions shall be current, complete, and accurate. All bidders must provide their full name, address and daytime/evening phone number. Bidders must be 18 years of age or older. Bidder agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of any transaction being conducted on and during the auction sale. 2 Rivers Auctions reserves the right to deny registration.

3. By placing a bid on an item, the bidder represents, warrants and undertakes that it has the authority and capacity to enter such bid and close the transaction and that any bid that it makes constitutes an irrevocable offer to buy the item in question for the full amount of the bid, plus the buyer's premium and any applicable taxes. A legally binding contract between a bidder, on the one hand, and 2 Rivers Auctions and seller, on the other hand, is formed when a bidder makes the highest bid and the online auction is closed. All sales are final; a bidder may not cancel a bid after the auction closes. When the auction closes, the highest bidder (referred to herein as "Buyer") shall pay for the item purchased by the date and time identified for removal on the specific auction site. If Buyer does not pay for and remove an item within the applicable removal period, 2 Rivers Auctions may resell the item without notice. If an item is resold for an amount less than the original, highest successful bid, Buyer is obligated to pay the difference. If full payment is not made by the end of the applicable removal period, Buyer's bidding privileges as to any other 2 Rivers Auctions may be suspended. Buyer's bidding privileges might not be reinstated until 2 Rivers Auctions invoice has been paid in full, regardless of whether an item has been resold.

4. ALL ITEMS ARE SOLD "AS IS", "WHERE IS", WITH NO WARRANTIES, EXPRESS OR IMPLIED. ILLUSTRATIONS, PICTURES OR VIDEOS POSTED ON 2 RIVERS AUCTIONS WEBSITE ARE FOR IDENTIFICATION PURPOSES ONLY AND ARE NOT WARRANTIES OF ANY TYPE. BUYER ASSUMES COMPLETE AND SOLE RESPONSIBILITY FOR INSPECTION OF ITEMS PRIOR TO BIDDING AND RELIES SOLELY ON ITS OWN INSPECTION AS TO THE CONDITION AND VALUE OF ITEMS. BUYER WAIVES ANY AND ALL CLAIMS AGAINST 2 RIVERS AUCTIONS AND SELLER BASED ON THE CONDITION OR VALUE OF ITEMS. 2 RIVERS AUCTIONS RESERVES THE RIGHT TO REJECT ANY AND ALL BIDS, REMOVE ITEMS FROM AUCTION AT ANY TIME OR EXTEND THE AUCTION DURATION. ALL ITEMS ARE SOLD TO THE HIGHEST BIDDER UNLESS ITEMS IS STATED AS HAVING A RESERVE AMOUNT, IN THAT CASE ITEM WILL NOT BE SOLD UNLESS RESERVE AMOUNT IS MET.

5. Unless a specific auction states otherwise, a 10% buyer's premium will be charged on all items and lots. Every bidder pays the same buyer's premium and should bid accordingly. For example, if you bid $100 on an item at the auction you will be charged $110 for the item on your auction invoice. Premiums other than this will be listed in the terms section of each auction.

6. If an item is subject to sales tax, 2 Rivers Auctions shall collect sales tax at the time of payment. Tax shall be calculated based on the successful bid price plus the buyer's premium.

7. Merchandise becomes the full responsibility of the Buyer at the time of sale and Buyer assumes all risk of loss and damage to property until removed from the sale premises. All removal is at the expense, liability, and risk of the buyer including disconnecting of utilities. Rights of the high bidder to purchase the item end on the last day and time of announced pickup. At this time the item/items will be considered abandoned by high bidder. 2 Rivers Auctions reserves the right to dispose of the item/items according to its discretion. Any high bidder that fails to complete a transaction will be held responsible for all damages resulting from that action include, but not limited to, storage costs, interest, filing fees, and attorney's fees. Items paid by the high bidder but not removed by the announced checkout will be considered abandoned, and will be disposed of at the discretion of 2 Rivers Auctions, unless alternate arrangements have been made in advance of auction close and approved by 2 Rivers Auctions. A refund will not be given. At the time of removal, the bidders or agents are responsible for checking that all paid/purchased items are in their possession. If there is a discrepancy, it must be resolved within one day of pickup.

8. Shipping and Handling. Buyer shall be solely responsible for the removal and/ or shipping of all items and all related costs. Buyer shall arrange with a third-party of Buyer's selection to have items picked up or shipped by the date and time identified for removal on the specific auction site.

9. Acknowledgment of Dangerous Auction Site: Potential bidders when inspecting and high bidders/purchasers or their agents acknowledge that an auction site is a potentially dangerous place. Every person enters the auction site at his or her own risk with notice of the condition of the premises and the activities that will be or have been conducted on the premises. High bidders will so advise their agents and employees. This acknowledged risk extends into all activities involved in the removal of items including disconnection of utilities. Persons attending the auction site during preview, sale or removal assume all risks of injury damage or loss of property and specifically release 2 Rivers Auctions and the seller from liability.

10. Choice of Law and Venue. All disputes relating to a 2 Rivers Auctions online auction and the terms and conditions herein shall be governed by and interpreted in accordance with the laws of the State of Minnesota. All claims relating to a 2 Rivers Auctions online auction and the terms and conditions herein shall be brought in "District Court in St. Louis County, Minnesota, and bidders hereby consent to the jurisdiction of said Court.
